These Terms & Conditions govern your use of the Australian Publishing Press website and the provision of publishing, writing, editorial, design, production, marketing and related services by Australian Publishing Press ("Australian Publishing Press", "APP", "we", "us" or "our").

By using our website, submitting an enquiry, requesting a quotation, purchasing our services, making a payment, or instructing us to commence work, you ("you", "client" or "author") agree to these Terms & Conditions.

If you do not agree to these Terms & Conditions, please do not use our website or engage our services.

1. About Australian Publishing Press

Australian Publishing Press is a publishing services business based in Victoria, Australia.

We provide professional support to new and established authors and may provide services including:

  • Book writing and ghostwriting
  • Manuscript development
  • Editing and structural editing
  • Proofreading
  • Book formatting and typesetting
  • Book cover design
  • Book illustration
  • Publishing assistance
  • Print and digital publishing preparation
  • Publication and distribution assistance
  • eBook services
  • Audiobook services
  • Book marketing and publicity
  • Author website development
  • Script writing
  • Editorial assessments
  • Other publishing and creative services agreed with the client

The services included in an individual project will be determined by the applicable quotation, proposal, invoice, package description or written agreement.

2. Agreement to Services

An agreement between you and Australian Publishing Press may be formed when you:

  • accept a quotation or proposal;
  • sign or electronically accept an agreement;
  • make a payment toward a project;
  • provide written confirmation that you wish to proceed; or
  • instruct us to commence work.

Once work has commenced, you agree to provide the information, materials, approvals and feedback reasonably required for us to provide the services.

3. Quotes and Pricing

All prices will be stated in the applicable quotation, proposal, invoice or service package.

Unless otherwise stated, prices are quoted in Australian dollars.

A quotation may specify:

  • services included;
  • project price;
  • payment schedule;
  • estimated timeframe;
  • number of revisions;
  • third-party costs;
  • applicable taxes or GST; and
  • other project-specific terms.

Unless otherwise stated, quotations are estimates based on the information available when the quotation is prepared.

Changes to the project scope may result in additional charges.

4. Payments

A deposit, initial payment or full payment may be required before work commences, depending on the service or project.

Where a project is divided into stages, Australian Publishing Press may require payment for a stage before commencing the next stage.

The client is responsible for ensuring that payments are made according to the agreed payment schedule.

Where payment is overdue, we may temporarily suspend work until the outstanding amount has been paid.

Suspension of work resulting from overdue payments may affect the estimated project completion date.

5. Project Scope and Additional Work

Our services are provided according to the agreed scope of work.

Additional work may be charged separately where it falls outside the agreed scope.

This may include:

  • additional manuscript revisions;
  • substantial changes to previously approved material;
  • additional editing;
  • additional proofreading;
  • additional design concepts;
  • additional revision rounds;
  • additional illustrations;
  • additional pages or chapters;
  • changes to an approved design;
  • changes to publishing specifications;
  • additional marketing services;
  • additional website functionality;
  • changes requested after production has commenced; or
  • other services not included in the original quotation.

Where reasonably practicable, we will notify the client of additional charges before undertaking additional work.

6. Ghostwriting and Book Writing Services

Where Australian Publishing Press provides ghostwriting or book writing services, the client is responsible for providing sufficient information, direction, source material and feedback to enable the project to be completed.

The client understands that ghostwriting involves collaborative development between the client and the writing team.

The final manuscript may be influenced by the client's instructions, feedback, source material and revisions.

Australian Publishing Press does not guarantee that a manuscript will become a bestseller, receive literary recognition, achieve a particular sales volume, receive positive reviews or generate a particular level of income.

Any marketing statements referring to potential success, visibility or commercial performance are not guarantees of future results.

7. Originality and Client Materials

The client is responsible for ensuring that materials supplied to Australian Publishing Press can lawfully be used for the project.

This includes manuscripts, ideas, photographs, artwork, illustrations, research, quotations, trademarks, personal information and other materials supplied by the client.

The client warrants that, to the best of their knowledge:

  • they own or have permission to use the materials supplied;
  • the materials do not knowingly infringe another person's intellectual property rights;
  • the materials are not knowingly unlawful or defamatory; and
  • they have obtained any necessary permissions or consents.

Where Australian Publishing Press creates original written, artistic or design material for a client as part of an agreed service, the ownership and usage rights will be determined by the applicable project agreement, quotation or invoice.

8. Manuscript and Editorial Services

Our editing and proofreading services are intended to improve the quality, readability, consistency and presentation of a manuscript.

Editing may include:

  • grammar and spelling;
  • punctuation;
  • structure;
  • flow;
  • readability;
  • consistency;
  • tone; and
  • other editorial improvements included within the selected service.

Editorial services do not constitute legal, medical, financial, academic or other professional advice unless expressly agreed otherwise.

The client remains responsible for the factual accuracy and final approval of the manuscript.

9. Publishing and Distribution

Australian Publishing Press may assist clients with the preparation and submission of books for publication and distribution through third-party platforms, retailers, distributors or other publishing channels.

Third-party platforms may impose their own requirements concerning:

  • content;
  • metadata;
  • formatting;
  • pricing;
  • royalties;
  • distribution;
  • territories;
  • account verification;
  • content approval; and
  • publication.

Australian Publishing Press cannot guarantee that a third-party platform will approve, list, distribute, promote or continue to make a particular title available.

Third-party platform decisions are outside our control.

10. Royalties and Book Sales

Where a publishing package provides that the author retains royalties or ownership of their work, the applicable project agreement will specify the relevant arrangements.

Statements such as "100% royalties" refer to the agreed royalty arrangement and do not necessarily mean that the author receives 100% of the retail price of a book.

Retailers, distributors, marketplaces, printers, payment providers or other third parties may deduct their applicable fees, costs or commissions before royalties are calculated or paid.

No particular level of book sales, royalties or revenue is guaranteed.

11. Book Design, Formatting and Proofs

Australian Publishing Press may provide book cover design, interior formatting, typesetting, illustration and other design services.

Where a proof or preview is provided, the client is responsible for carefully reviewing and approving the material before final publication or production.

The client should verify:

  • spelling;
  • names;
  • dates;
  • page numbers;
  • images;
  • captions;
  • formatting;
  • cover details;
  • author information;
  • ISBN information;
  • pricing; and
  • other publication details.

Once a proof has been approved, changes requested later may incur additional charges.

12. Printing and Physical Products

Where Australian Publishing Press arranges printing, printed books and other physical products may be subject to reasonable manufacturing tolerances.

Minor variations may occur in:

  • colour;
  • paper;
  • trimming;
  • binding;
  • print density;
  • finish; or
  • other production characteristics.

Where a product has a defect or otherwise fails to comply with applicable consumer guarantees, Australian Publishing Press will provide any remedy required by Australian law.

13. Marketing and Publicity

Australian Publishing Press may provide marketing, publicity and promotional services.

Marketing services may include campaign development, advertising, social media promotion, publicity, promotional materials or other agreed activities.

Marketing results depend on numerous factors outside our control.

We do not guarantee:

  • a particular number of book sales;
  • bestseller status;
  • media coverage;
  • reviews;
  • social media engagement;
  • advertising performance;
  • website traffic;
  • rankings;
  • revenue; or
  • a specific return on investment.

14. Author Websites

Where website services are provided, the project scope will be determined by the applicable quotation or agreement.

Unless expressly included, ongoing hosting, domain registration, premium software licences, third-party subscriptions, maintenance and future development may be charged separately.

The client is responsible for providing accurate content, images, contact information and other materials required for the website.

15. Client Approvals and Delays

Project timelines are estimates unless a specific completion date has been expressly agreed in writing.

Delays may occur where the client:

  • does not provide required information;
  • delays providing feedback;
  • requests additional work;
  • requests substantial revisions;
  • changes project requirements; or
  • does not approve material within a reasonable timeframe.

Delays caused by third-party platforms, printers, distributors, shipping providers, hosting companies or other external providers may also affect project timelines.

16. Cancellation and Refunds

Cancellation and refund arrangements may vary depending on the service, project stage and applicable agreement.

Where work has already been performed, fees for services already provided may not be refundable except where required by law.

Third-party costs already incurred on behalf of a client may also be non-refundable where those costs cannot reasonably be recovered.

Nothing in these Terms excludes, restricts or modifies any right or remedy available to a consumer under the Australian Consumer Law or other applicable legislation.

17. Australian Consumer Law

Australian Publishing Press acknowledges that Australian Consumer Law provides mandatory consumer guarantees for applicable goods and services.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

These rights operate in addition to any other rights available to you under Australian law.

Nothing in these Terms is intended to exclude or limit any consumer guarantee or other right that cannot legally be excluded.

18. Intellectual Property

Unless otherwise agreed in writing:

  • the client retains ownership of intellectual property supplied by the client;
  • Australian Publishing Press retains ownership of its pre-existing systems, templates, processes, methodologies and materials;
  • third-party materials remain subject to their applicable licences and terms; and
  • ownership or licensing of newly created project materials will be determined by the applicable project agreement.

The client must not reproduce or commercially exploit Australian Publishing Press's proprietary materials, templates, systems or processes without permission.

19. Confidentiality

Australian Publishing Press will take reasonable steps to protect confidential information provided by clients.

Client manuscripts and project information will be used for legitimate business and service-delivery purposes.

Information may be shared with employees, contractors or service providers where reasonably necessary to complete the client's project.

Our handling of personal information is additionally governed by our Privacy Policy.

20. Portfolio and Promotional Use

Unless otherwise agreed in writing, Australian Publishing Press may identify completed projects, publicly available book titles, book covers, author websites or other publicly available project information in its portfolio or promotional materials.

We will not intentionally publish confidential manuscript content for promotional purposes without appropriate permission.

Clients who do not wish their completed project to be used for portfolio or promotional purposes may contact us in writing.

21. Third-Party Services

We may use third-party providers including:

  • publishing platforms;
  • retailers;
  • distributors;
  • printers;
  • payment processors;
  • hosting providers;
  • cloud storage providers;
  • software providers;
  • marketing platforms;
  • advertising platforms; and
  • other technology or professional service providers.

Third-party services may have their own terms, policies and conditions.

We are not responsible for third-party changes, interruptions, delays or decisions outside our reasonable control, subject to any rights the client has under applicable law.

22. Website Use

You must not use our website to:

  • engage in unlawful activity;
  • attempt unauthorised access;
  • introduce malicious software;
  • interfere with website security;
  • impersonate another person;
  • infringe intellectual property rights;
  • submit fraudulent information; or
  • otherwise misuse the website.

We may restrict access to our website where reasonably necessary for security, maintenance or legal reasons.

23. Limitation of Liability

To the maximum extent permitted by law, Australian Publishing Press will not be liable for indirect or consequential losses arising from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Nothing in these Terms excludes, restricts or modifies rights available under the Australian Consumer Law.

24. Force Majeure

We will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control.

This may include natural disasters, fire, flood, government action, war, civil disturbance, telecommunications failures, major technology failures, cyber incidents, industrial disputes, supplier failures or other events outside our reasonable control.

25. Complaints and Dispute Resolution

If you have a concern about our services, please contact us first so that we have an opportunity to investigate and resolve the matter.

We will consider complaints in good faith and seek to resolve them within a reasonable period.

Nothing in this section prevents a client from exercising rights available under Australian law.

26. Changes to These Terms

We may update these Terms from time to time.

The latest version will be published on our website and will include a revised "Last Updated" date.

Changes will not retrospectively remove rights that have already accrued unless permitted by law.

27. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Subject to any mandatory rights available under Australian law, disputes arising in connection with these Terms will be subject to the jurisdiction of the courts and tribunals of Victoria, Australia.

28. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be read down or severed to the extent necessary.

The remaining provisions will continue to apply.

29. Entire Agreement

The applicable quotation, proposal, invoice, project agreement and these Terms collectively form the agreement between Australian Publishing Press and the client in relation to the relevant services.

Where a specific written project agreement conflicts with these Terms, the specific written agreement will prevail to the extent of the inconsistency.
